Cape Thermal: Warranty, Refund & Return Policy

These terms outline our policies and form an integral part of the general terms and conditions for transacting with Cape Thermal. As a specialised provider of high-end optics, we offer expert pre-purchase consultation to ensure you select the correct tool for your specific application before a transaction occurs.

1. Statutory Cooling-Off Period (Direct Marketing)

In accordance with Section 16 of the CPA, if a purchase resulted from direct marketing (email, SMS, or social media outreach), the consumer may rescind the transaction within 5 business days of delivery without reason or penalty. Goods must be returned at the consumer's expense and risk.

2. General Returns & Inspection Right

For all other orders where the consumer did not have the opportunity to inspect the goods prior to delivery, a 10-business day return window applies (Section 20).

  • Full Refund Eligibility: Goods must be returned in their original, unopened factory packaging with all security seals intact.
  • Condition Requirement: To prevent the return of "used" high-end optics, any device that has been registered to a software suite (e.g., HikMicro Sight, Pulsar Stream Vision), linked to a mobile device, or shows signs of mounting marks is considered "materially altered." Such returns are subject to the handling fees outlined in Section 4.

3. "Special-Order" Goods (Bespoke Items)

In terms of Section 17(1) of the CPA, Cape Thermal does not offer returns, cancellations, or refunds on special-order goods. These are items that Cape Thermal does not normally stock and has procured specifically at the request of the consumer. This includes:

  • Items specifically imported for a client.
  • Hardware manufactured or specifically configured to client specifications.
  • Bespoke thermal solutions designed for unique industrial requirements. Note: These items are clearly identified as "special order" on your quote and invoice.

4. Condition-Based Handling Fees

While the CPA prohibits fees for unopened returns, Cape Thermal reserves the statutory right under Section 20(6) to charge a technical handling fee of up to 25% if:

  • The factory security seals are broken, or the goods have been repackaged.
  • The goods have been used, mounted, or registered to a software profile, resulting in diminished resale value. This fee covers technical inspection, data sanitisation, and the "open-box" discount required to resell the specialised unit.

5. Implied Warranty of Quality

All products are backed by a 6-month statutory warranty (Section 56 of the CPA). If a product is found to be defective within this period, the consumer may elect for a repair, replacement, or refund.

  • Exclusions: This warranty does not cover damage resulting from misuse, unauthorised modifications, or physical damage (including mounting marks on scope tubes or lens scratches).
  • Extended Facilitation: Cape Thermal will continue to facilitate the manufacturer’s warranty process for the remainder of the specific manufacturer's warranty period (typically 12–36 months).

6. Return Shipping & Risk

  • Change of Mind / Cooling-Off: Returns are at the consumer's risk and expense. We strictly require a tracked service with full transit insurance.
  • Defective or Unsuitable Goods: If goods are found to be defective within the statutory warranty period or were misdelivered by us, the return is at Cape Thermal’s risk and expense.
